TERMS AND CONDITIONS OF LETTING
The Contract made between the Owners and the Lead Guest is subject to these Conditions and is only for the purpose of holiday occupation not exceeding 30 days.
1. DEFINITIONS
1.1 ‘Property’ refers to Rock Cottage (as above).
1.2 ‘You’/’Yours’/’Lead Guest’ refers to the person making the booking.
1.3 ‘Owner/s/’ refers to RAC & GL Dandy or Mrs LDM Dandy.
2. BOOKING CONDITIONS
2.1 You must be at least 18 years of age and must provide the Owner with your home address, telephone number and a personal email address. You must also provide the names and addresses (if different) of all the people who are to stay at the property. Any substitution must be agreed by the Owners in advance. The number of people occupying the property is limited to six (6). The Owner reserves the right to terminate the letting and request that you leave the property if this clause is not adhered to; no refund will be granted.
2.2 The Owner reserves the right to refuse a Let or grant access to the Property to any person deemed by the Owner to be unsuitable.
2.3 You agree to take full responsibility for ensuring that all members of your party adhere to these Conditions of Letting.
2.4 A Contract between You and the Owner will come into existence when the Owner provides you with written confirmation of booking for the dates of your letting of the Property. The Contract is under English Law. Your payment of the deposit for your stay confirms your acceptance.
2.5 Any dispute, claim or other matter which may arise in relation to your booking that cannot be resolved between you and the Owner will be governed by English Law and you agree that any dispute will be dealt with exclusively by the courts of England and Wales.
2.6 Any pet you intend to take with You should be declared at the time of booking. The Owner reserves the right to refuse a Let or grant access to the Property if any pet is deemed by the Owner to be unsuitable.
2.7 No bookings are valid until confirmed by the Owner in writing. If you have to cancel your booking, Section 4 of these Terms will apply. Whilst the Owner is under no obligation to do so, in certain circumstances, minor amendments to a booking may be considered. In these circumstances the Owner reserves the right to levy a charge equivalent of one half day (0.5) of the let.
2.8 Unless agreed to the contrary by the Owner, the rental period commences at 16:00 hours on the day of arrival.
2.9 You must vacate the Property by 10:00 hours on the day of departure.
2.10 You should ensure that all your possessions are removed from the Property, beds are unmade, doors locked and the Property left in a clean and tidy state.
2.11 Any breakages and damage must be reported to the Owner.
2.12 The Property key must be returned to the Owner.
3. PAYMENT
3.1 You are required to pay a deposit at the time of booking to secure the reservation.
3.2 The rent and deposit will be as advertised on the website or as agreed with the Owner and will be given on the Booking Confirmation.
3.3 The balance of rent plus any charge for a pet, is payable six (6) weeks before the start of the Let.
3.4 Acceptable methods of payment are:- online banking/bank transfer, Stripe (credit/debit cards) or PayPal.
3.5 Non-payment by the due date will be treated as a cancellation.
4. CANCELLATION POLICY
4.1 You must notify the Owner of any cancellation by email or telephone.
4.2 A request to change a booked date will be treated as a Cancellation.
4.3 Deposits are usually non-refundable.
4.4 The full rent is forfeit if a cancellation is less than 42 days before the due date of commencement of the period.
4.5 A full refund, including the deposit, will be made if the booking is cancelled by us due to circumstances beyond our control, e.g. fire or flood at the property.
4.6 We do suggest you arrange Cancellation Insurance to cover any unexpected eventualities.
5. DAMAGE
5.1 We expect our guests to respect our property and to look after it during their stay. A damage deposit is not required. However, a charge will be made for any unreasonable damage to the property, its contents and the boat or if these are left in an unacceptable condition.
6. GUEST RESPONSIBILITIES
6.1 You and Your party shall keep the Property, its contents and the boat if applicable, in the same state of repair as at the commencement of the Let, and shall leave the Property and the boat in the same state of cleanliness and general order in which it was found. The Owner reserves the right to make a charge to cover additional cleaning costs if any of the Property is left in an unacceptable condition.
6.2 None of the contents of the Property may be removed by you or members of your party. The Owner reserves the right to charge you for replacement of any contents that go missing from the Property during your stay.
6.3 You must notify the Owner of any damage or breakages to the Property and its contents during your occupancy. The Owner reserves the right to charge you for repair and replacement.
6.4 You must not part with possession of the Property or share it except with members of the party as detailed on the Booking Confirmation.
6.5 You must not exceed the total number of people or dogs stipulated on the Booking Confirmation. No further extra guests to sleep/visit/socialise or use the facilities at the Property during your Let are allowed.
6.6 You must permit the Owner reasonable access to the Property.
6.7 Your right to occupy the Property may be forfeited without compensation if:
- More people or pets than declared and/or the number the Property holds, attempt to take up occupation
- Overnight guests are entertained
- Any activity is undertaken which is illegal, or may cause unreasonable damage, noise, behaviour or disturbance
- Behaviour deemed by the Owner to be unreasonable may result in the Owner requesting you and your party to leave.
6.8 You are responsible for all members of your party whilst at the Property.
7. DOGS
7.1 Rock Cottage is offered, furnished and prepared by us for the comfort of our guests and we must consider the welfare and wishes of all our many visitors. Subject to the Owner’s prior agreement, a well-behaved dog is welcome when there are no more than (4) four persons staying in the property at any one time.
7.2 The dog is not permitted in the lounge or any of the bedrooms. It should not be left unattended in or at the Property at any time unless properly housed in a pet cage.
7.3 All dog waste must be bagged and disposed of responsibly.
7.4 You should endeavour to remove pet hair from the Property before you leave. We may charge you for any special cleaning or damage.
7.5 You must not wash dog bedding/towels in the washing machine or use the bathroom for cleaning the dog. An outside tap is available.
8. BOAT - ‘PEGGY’
8.1 A 3.5 metre rowing dinghy is provided. Weather and tides permitting, she will be made available from Easter to late October.
8.2 All guests using the boat, must follow the instructions provided in the Property regarding the care and use of 'Peggy'. If these are not followed, or the boat is found on the rocks, you will incur a charge.
8.3 Outboard motors are not permitted.
8.4 Unsupervised children must not use the boat at any time. A selection of life jackets are provided.
8.5 Use of the boat is at your own risk.
8.6 If you choose to use the boat, during wet weather, you will be expected to bail out rain water and check the mooring from time to time.
9. SMOKING AND VAPING
9.1 The Property has a strict No Smoking or Vaping policy which must be adhered to by you and members of your party at all times. Smoke alarms and emergency lighting must not be disabled.
9.2 The Owner reserves the right to charge you for cleaning costs necessitated by smoking within the Property.
10. PROPERTY DESCRIPTION
10.1 The information relating to the Property on www.rockcottagecornwall.com was accurate at the time it was created. You accept that minor differences between text or images may arise and that features and facilities at the Property may be changed or removed.
10.2 The Owner cannot accept responsibility should the Property not conform exactly to your expectations. If a feature or facility is important to you, please check with the Owner prior to confirming your booking.
11. COMPLAINTS
11.1 Any complaints must be notified to the Owner as soon as possible to enable an on-the-spot investigation to be carried out and where practicable, remedial action taken by the Owner.
12. SECURITY
12.1 You will be provided with a key to the Property. Other keys, if appropriate will be available at the Property. In the event that any keys issued are lost or not returned at the end of your stay, the cost of replacement will be charged to you.
12.2 During your stay you must ensure that all doors and windows are securely closed when you are away from the property.
13. ELECTRIC VEHICLE CHARGING
13.1 We do not have on-site charging facilities at Rock Cottage. You must therefore make your own arrangements for EV charging.
13.2 Although many EVs are supplied with a domestic charger, these are not permitted at the Property as they invalidate the buildings insurance whether directly connected to a power socket or via an extension cable.
13.3 You are solely liable for any damage to the Property or loss suffered by the Owner as a result of your unauthorised use of a domestic charger connected to a power socket within the Property either directly or via an extension cable. For the avoidance of doubt: The use of domestic chargers is strictly forbidden.
13.4 The closest charge points to the Property are approximately 3 miles at Tesco and Sainsburys’ in Helston.
14. SUBSCRIPTION STREAMING SERVICES
14.1 You may access your personal subscription streaming service whilst at the Property.
14.2 You are responsible for controlling access to your party’s account(s) which if installed by Your party on our compatible devices should be removed on Your departure.
14.3 The Owner is not responsible for any costs incurred relating to services obtained through your account(s).
15. UNAVAILABILITY OF THE PROPERTY
15.1 Your booking will not be cancelled by the Owner other than in exceptional circumstances beyond the Owner’s control. In the event of such a cancellation you will be notified by the Owner as soon as possible via email and telephone. The Owner will promptly refund all payments made in relation to the booking. Alternatively, you and the Owner may agree to reschedule your booking to a later date.
15.2 The Owner’s liability is limited to the total value of the payments made by you in relation to the booking. The Owner will not pay any compensation or expenses.
16. OWNER’S RESPONSIBILITY
16.1 The Owners will not be liable for any act, neglect or default on the part of any person not within their employ or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience whether to personal property which You or any other person may suffer or incur arising out of or in any way connected with the rental, unless the Owner is responsible. In addition, the Owners accept no responsibility for loss or damage to the guests’ possessions on the Owner’s property or land.
16.2 Nothing in this Contract excludes or limits the liability of the Owners for death or personal injury caused by the Owners’ negligence.
17. PRIVACY AND DATA PROTECTION
17.1 The Owner confirms compliance with the UK Data Protection Act 2018 regarding any data you provide.
17.2 The Privacy Policy can be viewed on the Property’s website as below or a copy obtained from the Owner.
